Terms of Service

Agreement to these terms

By creating an account or using the Laudy platform in any way, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

Changes to terms

We may update these terms periodically. We will notify you of material changes via email or an in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

Eligibility

You must be at least 18 years old and have the legal authority to enter into this agreement on behalf of yourself or your business.

What Laudy provides

Laudy is a reputation management platform that enables businesses to send review requests, monitor and respond to reviews across platforms, display review widgets on their websites, and collect video testimonials.

Platform availability

We aim for 99.9% uptime but do not guarantee uninterrupted access. Scheduled maintenance, unexpected outages, or third-party platform changes (Google, Yelp, Facebook) may temporarily affect service.

Third-party integrations

Laudy connects to third-party platforms via their official APIs. We are not responsible for changes those platforms make to their APIs, terms, or policies that affect our service's functionality.

Free trial

New accounts may access a free trial of paid features. We reserve the right to modify or discontinue free trial terms at any time.

Accurate information

You agree to provide accurate, complete, and current information during registration and to keep your account information updated.

Account security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at hello@laudy.co if you suspect unauthorized access.

Customer data responsibility

When you upload customer contact information, you represent and warrant that you have obtained appropriate consent to contact those individuals, in compliance with CAN-SPAM, TCPA, GDPR, and any other applicable laws.

Compliance

You are responsible for ensuring your use of Laudy complies with all applicable laws and regulations in your jurisdiction.

Spam and harassment

You may not use Laudy to send unsolicited communications (spam), contact individuals who have opted out, or harass any person.

Platform terms violations

You may not use Laudy in ways that violate the terms of service of Google, Yelp, Facebook, or any other connected review platform.

Misuse and abuse

You may not attempt to reverse engineer, scrape, overload, or otherwise interfere with the Laudy platform or its infrastructure.

Illegal activity

You may not use Laudy for any unlawful purpose, including to defame, harass, or infringe on the intellectual property rights of others.

Subscription billing

Paid plans are billed monthly or annually, in advance. Your subscription renews automatically at the end of each billing period unless you cancel.

Free plan

The Free plan is available at no charge subject to usage limits. We reserve the right to modify the Free plan features and limits with 30 days notice.

Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. We do not offer refunds for partial billing periods.

Annual plan refunds

Annual subscriptions canceled within 14 days of the initial purchase are eligible for a full refund. After 14 days, annual plans are non-refundable but you retain access through the end of the paid period.

Price changes

We will notify you at least 30 days in advance of any price increases. Price changes take effect on your next renewal date.

Taxes

Prices do not include applicable taxes. You are responsible for any sales tax, VAT, or similar taxes applicable to your subscription.

Termination by you

You may close your account at any time by contacting us at hello@laudy.co or using the account deletion option in settings.

Termination by Laudy

We reserve the right to suspend or terminate your account, with or without notice, for violation of these Terms — particularly for prohibited conduct including fake review generation.

Effect of termination

Upon termination, your right to access the service ceases immediately. We will delete your data within 30 days of account closure, except where retention is required by law.

Data export

Prior to closing your account, you may export your data from your account settings.

Disclaimer of warranties

The Laudy service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of damages

To the maximum extent permitted by law, Laudy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising from your use of the service.

Liability cap

In no event shall Laudy's total liability to you exceed the fees you paid to Laudy in the twelve months preceding the claim.

Third-party platforms

Laudy is not responsible for actions taken by Google, Yelp, Facebook, or any other third-party platform, including removal of reviews, account restrictions, or API changes.

Texas law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

Dispute resolution

Any dispute arising under these Terms shall be resolved by binding arbitration in Austin, Texas, under the rules of the American Arbitration Association, unless you are located in the EU, in which case applicable EU dispute resolution mechanisms apply.

Class action waiver

You agree to resolve disputes with Laudy only on an individual basis and waive the right to participate in a class action lawsuit or class-wide arbitration.
